These Terms of Service ("Terms") form an agreement between you and AIFO, Inc. ("AI.FO", "we", "us", or "our") and govern your access to and use of AI.FO (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you agree on its behalf and represent that you are authorized to do so.
AI.FO is a financial intelligence application. It connects to accounting data you choose to provide, such as QuickBooks Online, which it accesses on a read-only basis, or files you upload, computes financial signals from that data, and produces analysis and written summaries. Features available to you depend on your plan.
Paid plans are offered on a recurring subscription basis. By subscribing, you authorize us and our payment processor to charge the fees for your selected plan, at the price and billing interval presented to you at the time of purchase, on a recurring basis until you cancel.
If you connect QuickBooks Online, you authorize AI.FO to access your accounting data through the QuickBooks authorization you grant through Intuit; AI.FO uses that connection on a read-only basis and does not write to your QuickBooks account. Your use of that connection is also subject to Intuit's applicable terms. The following terms apply to data and functionality provided through Intuit:

You agree not to:
You retain ownership of the data you provide. You grant AI.FO the rights needed to host, process, and display that data to provide the Service to you and, where you request it, to generate analysis and written summaries. AI.FO and its licensors own the Service, including its software, models of operation, and content, other than your data. Our handling of personal information is described in our Privacy Policy.
The Service provides financial information and analysis for your business's internal use. It is not financial, accounting, tax, legal, or investment advice, and it does not replace the judgment of a qualified professional. You are responsible for decisions you make based on the Service.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, AI.FO and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data. Our total liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve months before the event giving rise to the claim.
You agree to indemnify and hold AI.FO harmless from claims arising out of your use of the Service, your data, or your violation of these Terms, to the extent permitted by law.
You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; the sections that by their nature should survive will survive.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in Delaware will have jurisdiction over disputes arising out of these Terms, except where applicable law provides otherwise.
